Terms of Service

These Terms of Service (“Terms”) govern your use of the FitConnect mobile application (the “App”) operated by Alem Zukic (“we”, “us”, “our”). By creating an account or using the App, you agree to these Terms.
If you do not agree, do not use the App.

1. The service
FitConnect is a discovery and listing platform that helps clients find personal trainers in their area and helps trainers list their services. We provide the App as a meeting point.
FitConnect does not process payments for training sessions. All payments for actual training sessions are arranged and settled directly between client and trainer, outside the App. We are not a party to those transactions and have no liability for them.
The only payments processed in the App are Boost Token in-app purchases made by trainers (described in Section 6).
2. Eligibility
You must be at least 17 years old to use the App. By creating an account, you confirm you meet this age requirement.
3. Accounts
3.1 Registration
You may register as a client or as a trainer. You must provide accurate information and keep it up to date.
3.2 Credentials
You are responsible for keeping your password secure. Notify us immediately at alem.zukic77@gmail.com if you suspect unauthorized access.
3.3 Account deletion
You may delete your account at any time via Profile → Delete Account. See the Privacy Policy for what happens to your data.
4. Trainer obligations
If you register as a trainer, you represent and warrant that:
- You hold any certifications or licenses you claim in your profile.
- The personal information, photos, and pricing you publish are accurate and represent your real services.
- You will conduct sessions professionally and respect each client’s privacy and physical safety.
- You will not solicit payment within the App’s chat for sessions in a way that bypasses Apple’s In-App Purchase rules. Real-world session payments are arranged outside the App; this is permitted.
- You will not use the App to harass, defraud, or harm clients.
We may, at our sole discretion, suspend or remove trainer profiles that we believe violate these obligations.
5. Client obligations
If you register as a client, you agree:
- To respect the trainer’s time and cancel bookings reasonably in advance when you cannot attend.
- To pay the trainer for completed sessions through the means you arranged with them directly. FitConnect is not responsible for unpaid sessions.
- To rate trainers honestly. Reviews used for harassment or to promote a competing business may be removed.
6. Boost Tokens (in-app purchases)
6.1 What they are
Trainers may purchase “boost credits” through Apple’s In-App Purchase system. These credits are spent within the App to temporarily rank a trainer’s profile higher on the Discover map and list. Available boost durations are 1, 3, 7, and 30 days.
6.2 No external value
Boost credits are a digital, in-app feature with no real-world value. They:
- Cannot be transferred between accounts.
- Cannot be exchanged for cash.
- Cannot be resold.
- Have no value outside the App.
6.3 Refunds
All in-app purchases are processed by Apple. Refund requests are handled through Apple via reportaproblem.apple.com. We honor any refund Apple issues — when notified, we deduct the corresponding credits from the trainer’s balance (clamped to a minimum of zero).
6.4 Service interruption
If your purchased credits do not appear in your balance within a few minutes, try the “Restore Purchases” button in Buy Credits. If the issue persists, contact us.
7. Acceptable use
You agree NOT to:
- Impersonate another person or misrepresent your identity.
- Upload content that is illegal, defamatory, sexually explicit, hateful, or infringing on others’ intellectual property.
- Send spam or unsolicited commercial messages through the chat.
- Reverse-engineer, scrape, or attempt to extract data from the App in bulk.
- Use the App to facilitate any service that violates Apple’s App Store Review Guidelines or applicable law.
- Interfere with the App’s security or operation.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
8. User content and license
You retain ownership of the content you upload (photos, bio, reviews, chat messages). By uploading content, you grant us a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute that content within the App for the purpose of operating the service.
You are solely responsible for the content you publish. We may remove content that violates these Terms.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. We do not guarantee:
- That trainers listed in the App are licensed, insured, or qualified — always verify their credentials before booking a session.
- That clients will pay for sessions or behave appropriately.
- That the App will be uninterrupted or error-free.
Training and exercise carry physical risk. You undertake any training session at your own risk. Consult a doctor before beginning a new exercise program.
10. Limitation of liability
To the maximum extent permitted by law, FitConnect, its operators, and its service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from your use of the App.
Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us in In-App Purchases in the past 12 months, or (b) USD 50.
11. Termination
We may suspend or terminate your account at any time, for any reason, including (without limitation) a breach of these Terms. You may stop using the App and delete your account at any time. Sections 6.2, 8, 9, 10, 12, and 13 survive termination.
12. Governing law
These Terms are governed by the laws of Bosnia and Herzegovina, without regard to its conflict-of-laws principles. Any dispute will be brought before the competent courts of Sarajevo, Bosnia and Herzegovina.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the App and the “Last updated” date above will reflect them. Your continued use of the App after a change means you accept the updated Terms.
